We are looking for a proactive and detail-oriented Legal Counsel to join our dynamic team. The ideal candidate will have 3-5 years of experience in European laws and regulations, particularly in general contract law, product quality, consumer protection, labor law, and general business. The candidate should have a strong understanding of the European legal landscape, particularly in Germany, to support our business in Europe, and will be fluent in both English and/or German and Mandarin to facilitate seamless communication with our headquarters in China.
The Legal Counsel will provide legal advice, draft and review contracts, ensure compliance with local regulations, and handle a variety of legal matters related to distributor network, product quality, consumer protection, labor, and corporate issues. This position requires strong communication and collaboration skills, including working closely with local legal consultants and internal teams to address various legal matters.
Key Responsibilities
* Legal Consulting and Advisory:
o Provide legal advice and support on general contract law, product quality, consumer protection, and business operations.
o Advise on compliance with European and German laws and regulations, particularly those related to consumer products, e-commerce, and data protection (e.g., GDPR).
o Provide compliance advice on German labor relations matters. Assist with labor and employment law issues, such as employee contracts, workplace policies, and disputes.
o Offer legal guidance on product quality standards, warranty policies, and liability issues.
o Support general corporate legal matters, including company information changes, governance, and compliance.
* Contract Drafting and Review:
o Draft, review, and negotiate contracts related to the operations of German entities in Europe, including distributor agreements, sales agreements, after-sales service agreements, and other service contracts related to business operations.
o Ensure contracts align with company policies, legal requirements, and business objectives.
* Collaboration:
o Act as a liaison between the European team and the headquarters in China, ensuring clear and effective communication.
o Partner with external legal advisors and local law firms to navigate legal matters specific to different EU jurisdictions.
o Serve as the main point of contact for legal inquiries related to the EU and other jurisdictions.
o Manage and mitigate legal risks, ensuring business decisions align with legal requirements.
o Assist in the development and implementation of company policies to comply with relevant laws and industry standards.
Qualifications and Skills
Education: A law degree from a recognized university; admission to the German bar (Rechtsanwalt) is highly preferred.
Experience: 3-5 years of relevant legal experience, preferably in a law firm and in-house legal department in EU countries.
