Hauptaufgaben Serves as paralegal, victim witness liaison, and translator in support of the work of the International Law Division. The Division is responsible for providing legal advice and guidance on all matters involving international law, US and foreign civil and military law, the applicability of United States laws in Germany, and Status of Forces Agreements affecting the command and its personnel. Incumbent is responsible for the examination, preparation, and management of case files for legal action; identification of relevant factual and legal issues; service of documents; translation of case documents, reports and correspondence; and interpreter support during preliminary interviews of witnesses. In addition, incumbent serves as the victim/witness liaison in US forces criminal proceedings. In the event the troop strength or strength of the civilian component increases significantly in the areas for which the Kaiserslautern International Law Division has legal liaison responsibility, the duties outline in paragraph 1 below may be reduced in favor of duties outlined in paragraphs 3 – 5 below. Interviews clients such as staff action officers, commanders, law enforcement personnel, and legal counsel seeking advice in the above-described areas of law. Receives inquiries and requests for legal review telephonically, electronically, and in person. Directly assists or refers clients and legal counsel to appropriate authorities and legal counsel or legal departments if the legal issue is not appropriate for the immediate office. In complex cases, analyzes initial problem during client intake process; independently identifies what facts are legally significant for attorney's information; and gathers additional facts and information from clients. Compiles gathered information and relevant legal materials; creates appropriate case files; and researches history of similar action in historical files. Maintains an archival system of precedent-setting legal opinions, both in paper and in electronic format, as well as other office files, litigation reports, and legal reference materials. Accounts for incoming and outgoing correspondence, overseeing the archiving of these records in accordance with applicable regulations. Serves as victim/witness liaison for the Kaiserslautern International Law Division. In that capacity and in cooperation with the trail counsel, informs victims and witnesses of their rights in military and German proceedings, to include the right to restitution. The duties will apply to German proceedings when any portion of the criminal investigation or prosecution was conducted primarily by the Army or other Department of Defense components. Monitors and advises victim/witnesses of US and German trial proceedings, results of trial or appellate proceedings, release of perpetrator from imprisonment or other significant events. Additionally, incumbent assists the trial counsel with locating and interviewing witnesses. In close cooperation with the military justice section, makes necessary travel and lodging arrangements for court martial appearance, and assists the victim with obtaining appropriate compensation under US or German law. Attends victim/witness conference when required. Translates complex technical and legal documents including court judgements, legal opinions, writs of indictment, statements, medical certificates, reports, expert opinions, affidavits, traffic accident reports, German police reports, claims documents, and correspondence to and from prosecutors, courts and attorneys from German to English and vice versa. Determines whether material for translation should be verbatim, extraction of parts of documents or a summarization of case content, as well as what information is pertinent and essential to provide a comprehensive basis for further review, decision, and legal action taken on cases, reasons for delay, reasons for return of cases, etc Provides interpretation and translation support for criminal investigations, trial proceedings, and preliminary interviews with witnesses as required. Serves documents upon request from German courts and authorities. Receives inquiries and documents and determines nature of actions requested. Takes appropriate action in accordance with standardized office procedures and a detailed catalogue of instructions; determines feasibility of such requests in conjunction with international agreements, administrative agreements, Army regulations, governing jurisdiction exercised by foreign courts over US personnel involved, and previous actions taken by US authorities and personnel. Contacts German legal authorities to obtain additional facts on a case. Based on developed facts of a case, determines type and sequence of actions to be taken by US authorities and personnel established in agreements, US Army regulations and policies, and advises the commander of the individual concerned accordingly. Locates individual concerned. Serves documents on individuals, in person, through the commander or supervisor, by mail or electronically, and explains the administrative process involved. Informs the individual of the content of document served. Renders further explanations if necessary, and advises the individual and the commander/supervisor on proper action to be taken. Refers individuals needing legal advice to legal assistance or counsel in private practice. Notifies pertinent German courts or authorities of actions or proceedings taken and conveys reason for delay in handling requests at the earliest possible time. Returns documents submitted for service to originating German authorities when service cannot be effected by military authorities. Provides notification of new factors introduced to the case such as, proof of payment of the case being litigated or rotation to CONUS. Notifies the commander concerned and USAREUR Vehicle Registry of suspension or revocation of drivers' licenses by German courts or authorities. Composes letters, endorsements for insertion to standard letters, etc. setting forth actions to be taken by individuals and unit commanders involved, as required under SOFA and Supplementary Agreement. For reference and control purposes, maintains logs and case history files. Serves as caseworker in foreign criminal jurisdiction cases. In this capacity, receives and processes German criminal law case files or documents for notification of commanders, trial counsel or service of process of the individual concerned. Where required, coordinates action with German court and prosecution officials. Performs other duties as assigned.
